Ultimately, the B. C. Human Rights Tribunal decided that there was no evidence Dutton had physically seduced Mahmoodi, but found him guilty anyway of “creating a sexualized environment.” He was fined $13,000. His legal expenses are already in six figures.

The Tribunal ordered the Respondents to pay Ms. Arias $25,000 as compensation for the humiliation and loss of dignity resulting from the infringement of her rights and $5,000 as compensation for her mental anguish. In addition, the Tribunal ordered the Respondents to implement a comprehensive workplace anti-harassment and anti-discrimination policy. All management employees and owners were also required to take an educational program on anti-discrimination and sexual harassment principles.

In light of Ms. P’s particularly compelling circumstances and the evidence from this investigation, and in view of the level of compensation generally available in human rights matters, the Ombudsman recommended the OHRC pay Ms. P $4,000 and provide her with an apology.
